Matiang'i Speaks Out on Miguna Miguna's Woes

Interior Cabinet Secretary Fred Matiang’i on Wednesday defended the government against claims that it is behind Miguna Miguna's travel woes.

Instead, Matiang’i blamed the existing laws, saying that they have made it difficult for people who had previously renounced their Kenyan citizenship to regain it.

“We are witnessing a lot of acrimony on an issue everyone thinks is common sense. We are not the ones who passed the laws,” Matiang’i said in Mombasa.

He clarified that it was not the government’s intention to frustrate Miguna and other Kenyans wishing to regain their lost citizenship but that the ministry has proposed amendments to existing laws to facilitate the process.

“I’ve written to the Attorney-General, on advice from the technical people, to look at our proposals and if in agreement, to forward to parliament,” added Matiang’i.

Matiang’i mentioned the Citizen and Foreign National Management Services Act of 2011, which he said contains prohibitive provisions, among the laws that need to be amended.

“If we fail to implement it we will be hammered. Now that we are implementing, we are hammered,” he said.

“The old constitution did not have provisions for dual citizenship. So those Kenyans who denounced their citizenship should be facilitated to regain their citizenship. We have an opportunity now to embark on huge level statutory changes. We have come up with our proposals.”

Miguna, who was set to arrive in the country on January 7th, is presently stuck in Germany after airlines refused to fly him to Kenya or any other African nation over a red alert allegedly issued by the government of Kenya.

I don't see what the Citizen & Foreign National Management Service Act, 2011 has to do with the process of regaining citizenship. The spirit of the creation of this Act was to create a "corporate body" or service. On the other hand, the Kenya Citizenship & Immigration Act 2011, Part III, section 10 sets clearly the process of "regaining citizenship". This is but a red herring. The government needs to do better and fast track those in the Diaspora who have applied to regain their citizenship. A two-year wait processing time is unacceptable.

If you look at the size of Miguna in the photo and compare to size of other passengers, one can see the work of photoshop. These reports are prepared by one person and emailed to reporters. The reporters need to understand that they owe us (the readers) more than publishing what they get from their clients. reading this story, one wonder why the reporter is not interested with Matiang'i proposal? Either the story is a fabrication, or the report is not competent.

The Kenyan government can not be making false claims and allegations to justify its refusal to obey court orders.

@Kenya losing Citizenship is a legal process.

You cannot lose citizenship “Automatically “, it’s a legal process.

You have to prove using paper work that you renounced your citizenship.

It’s like divorce unless you file for divorce you will be legal married to your spouse forever.

Before the year 2010, one did not require to openly denounce Kenyan citizenship. All one needed to do was to be a citizen of another nation and that automatically takes one out as bonafide Kenyan citizen.

It’s renouncing citizenship is a legal process.

What 'proof' are you talking about? The only true proof of Citizenship recognized by the World is a passport. Miguna has a Canadian passport, which was acquired before the 2010 Constitution was passed. The Kenyan Constitution before 2010 did not allow dual citizenship, so Miguna ceased to be a Kenyan citizen, when he became a Canadian, before 2010. He aquired a Kenyan passport by fraud, and is trying to enter Kenya illegally, according to global legal requirements. He is a human being, like everyone else. Let him follow the same order that human beings follow.

Renouncing citizenship is a legal process that must be supported by legal documents showing Miguna voluntarily renounced his citizenship.

The Kenyan government must show the world the legal documentation that have Miguna’s signature stating he has renounced his citizenship.

These documents must show the date, tome and the person who verified this act of renouncing of citizenship.

You are incorrect. You ceased to be a Kenya citizen if you acquired citizenship of another country after age 21. There were loopholes for women and children like Mwinzi but none for men. Yes the law should be changed but that does not change the fact the he ceased to be a kenya citizen and acquired a Kenya passport through illegal means. Damn facts!! They are stubborn things

Google Kenya subsidiary legislation 1963(this was the relevant constitution until 2010), download the pdf go to page 14 section 3 and read to your hearts content- this way you can't say I'm making stuff up. Instead of trying to defend dear leader's illegal actions, work on the eliminating that regaining Kenya citizenship clause and make it automatic for those who automatically lost it after obtaining citizenshIp elsewhere

@Guest, from your arguments, I believe that you only have a Kenyan passport. To get a US or Canadian passport, you have to attend a Ceremony, where you raise your right hand, and swear allegiance to the US, or Canada, and renounce your former Citizenship, whether by birth or not.

No it doesn't. All it does is prove where you were born. It does not account for actions you took after that date that could cause you to have lost your citizenship. If you bother to read the old constitution, you will note his actions (becoming a Canadian citizen) effectively meant he lost his Kenya citizenship. Once again here is the oath he took: “I swear (or affirm) that I will be faithful and bear true allegiance to Her Majesty Queen Elizabeth II, Queen of Canada, her heirs and successors, and that I will faithfully observe the laws of Canada and fulfil my duties as a Canadian citizen.” please note that nowhere in that oath is Kenya included.

Citizens and Foreign National Management Act is evil and must be amended. It is mischievous and the intent of those who crafted and passed it is suspect. The aim was to eliminate diaspora competition. The Miguna madness will end up benefitting Diaspora with regard to dual citizenship.

Last week the gova spokesperson said Miguna was unruly and thats why he can not fly into Kenya or even Africa. Today Matingi has changed the story. Next week it will be something else which is all nonsensical because Miguna was pulled out of his bed and bundled up into a plane after being forcefully given a tranquilizer like an animal and had his Kenyan passport taken from him. Gross abuse of human rights. Black self hate. You don't treat a fellow brother like that. So sad the taxpayer will pay for this in future.

Miguna has already said he never renounced his citizenship.

So how did the Kenyan government come up with information he renounced his citizenship?

Let me educated kenyans black wazungu who want to die kwa wazungu country.Once u acquire another pp you have to go to nyayo hse AG office n file paper work for yr dual to b approved,u pay i think 6000ksh then ur given a letter to show it's ok to have dual if u haven't done this u can b shipped back like miguna thou ya miguna happened b4 2010 when we didn't have dual,after 2010 sheria gave those wapoteanji to file back to regain lost kenyan citizenships but instead of thug miguna doing so by following the process he bribed or he was given fake kenyan pp by raila n kajwang during coalition gava so let's grow up especially watu wadiaspora n we follow the kenyan law the way most of u do respecting the wazungu law.Bure kabisa.

There is no paperwork to prove.If he lost his citizenship when he acquired Canadian citizenship because at the time the Kenyan laws did not allow for dual citizenship then he can reapply for Kenyan citizenship because the laws have changed now.The law applies equally to all therefore all those Kenyans who lost their citizenship by acquiring another country’s citizenship regardless of whether they were born in Kenya or not must reapply.A dog barks loudest in his own backyard .He is currently in Germany .They do not care about him or who he perceives himself to be.Until he gets the proper paperwork he will not be allowed to fly.Sending messages on Facebook and insulting politicians is doing him no good.Bwana you are not home at this point the Kenyan government has the upper hand .He can prove he was born in Kenya he can afford the passport application fee if anything tweet Matiangi and hold him to his word that he will get his passport in 3 days.Instead of bragging to reporters how you are spending Kshs 3 Million on hotels wacha ujaluo utaiokota ukifika Kenya.

He could have entered Kenya simply, and legally, with his Canadian passport. All he had to do was to get a $50 Visa at JKIA upon arrival. All these shenanigans will make it harder for him to travel anywhere in future, even with a Kenyan passport. Even if the GoK okays his travel, Airlines can still say that they don't want him in their Aeroplane. No Judge can 'Order' an Airline to have Miguna as their passenger. Mgonga Ukuta humia mwenyewe.
