Matiang'i Speaks Out on Miguna Miguna's Woes
Interior Cabinet Secretary Fred Matiang’i on Wednesday defended the government against claims that it is behind Miguna Miguna's travel woes.
Instead, Matiang’i blamed the existing laws, saying that they have made it difficult for people who had previously renounced their Kenyan citizenship to regain it.
“We are witnessing a lot of acrimony on an issue everyone thinks is common sense. We are not the ones who passed the laws,” Matiang’i said in Mombasa.
He clarified that it was not the government’s intention to frustrate Miguna and other Kenyans wishing to regain their lost citizenship but that the ministry has proposed amendments to existing laws to facilitate the process.
“I’ve written to the Attorney-General, on advice from the technical people, to look at our proposals and if in agreement, to forward to parliament,” added Matiang’i.
Matiang’i mentioned the Citizen and Foreign National Management Services Act of 2011, which he said contains prohibitive provisions, among the laws that need to be amended.
“If we fail to implement it we will be hammered. Now that we are implementing, we are hammered,” he said.
“The old constitution did not have provisions for dual citizenship. So those Kenyans who denounced their citizenship should be facilitated to regain their citizenship. We have an opportunity now to embark on huge level statutory changes. We have come up with our proposals.”
Miguna, who was set to arrive in the country on January 7th, is presently stuck in Germany after airlines refused to fly him to Kenya or any other African nation over a red alert allegedly issued by the government of Kenya.

I don't see what the Citizen & Foreign National Management Service Act, 2011 has to do with the process of regaining citizenship. The spirit of the creation of this Act was to create a "corporate body" or service. On the other hand, the Kenya Citizenship & Immigration Act 2011, Part III, section 10 sets clearly the process of "regaining citizenship". This is but a red herring. The government needs to do better and fast track those in the Diaspora who have applied to regain their citizenship. A two-year wait processing time is unacceptable.

What 'proof' are you talking about? The only true proof of Citizenship recognized by the World is a passport. Miguna has a Canadian passport, which was acquired before the 2010 Constitution was passed. The Kenyan Constitution before 2010 did not allow dual citizenship, so Miguna ceased to be a Kenyan citizen, when he became a Canadian, before 2010. He aquired a Kenyan passport by fraud, and is trying to enter Kenya illegally, according to global legal requirements. He is a human being, like everyone else. Google Kenya subsidiary legislation 1963(this was the relevant constitution until 2010), download the pdf go to page 14 section 3 and read to your hearts content- this way you can't say I'm making stuff up. @Guest, from your arguments, I believe that you only have a Kenyan passport. To get a US or Canadian passport, you have to attend a Ceremony, where you raise your right hand, and swear allegiance to the US, or Canada, and renounce your former Citizenship, whether by birth or not.

No it doesn't. All it does is prove where you were born. It does not account for actions you took after that date that could cause you to have lost your citizenship. If you bother to read the old constitution, you will note his actions (becoming a Canadian citizen) effectively meant he lost his Kenya citizenship. Once again here is the oath he took: “I swear (or affirm) that I will be faithful and bear true allegiance to Her Majesty Queen Elizabeth II, Queen of Canada, her heirs and successors, and that I will faithfully observe the laws of Canada and fulfil my duties as a Canadian citizen.” please note that nowhere in that oath is Kenya included.

He could have entered Kenya simply, and legally, with his Canadian passport. All he had to do was to get a $50 Visa at JKIA upon arrival. All these shenanigans will make it harder for him to travel anywhere in future, even with a Kenyan passport. Even if the GoK okays his travel, Airlines can still say that they don't want him in their Aeroplane. No Judge can 'Order' an Airline to have Miguna as their passenger. Mgonga Ukuta humia mwenyewe.
