DPP Withdraws Murder Charges Against Slain Dutch Tycoon Tob Cohen’s Widow Sarah Wairimu

The Director of Public Prosecutions (DPP) Noordin Haji has withdrawn the murder charges against Sarah Wairimu, the widow of slain Dutch tycoon Tob Cohen.

Wairimu and two others had been charged with murdering Cohen, who went missing on July 19th, 2019, before he was found dead about two months later on September 13th.

In a notice dated November 29th, Deputy DPP Jacinta Nyamosi said she was instructed to withdraw the murder case against Wairimu and her co-accused and instead have it registered as an inquest.

“I have been directed by the Director of Public Prosecutions to inform the Honourable Court that we have filed a Nolle Prosequi in the above matter and withdrawn the murder case against Sarah Wairimu Kamotho and Peter Karanja in the exercise of the DPP’s mandate under Article 157 of the Constitution and section 82(1) of the Criminal Procedure Code,” read the notice.

"The DPP has directed that this matter be handled via inquest to be filed in the Chief Magistrates court `Milimani Nairobi…This will enable the contradictions that have affected the proceedings of this matter to be heard in detail by all parties. In addition, this will provide an opportunity for parties to present any information that had not been explored substantially before the court.”

The move comes a month after Wairimu, through her lawyer, called for fresh investigations into her husband’s murder following allegations that former DCI director George Kinoti may have forced a detective to falsely implicate her in the murder.

The decomposed body of Cohen, who had lived in Kenya for 32 years, was discovered in an underground tank at his lavish home in Nairobi’s Kitisuru estate. 

A postmortem revealed that the deceased suffered severe head trauma inflicted by a blunt object and succumbed to a blow to the right side of the head. The 71-year-old was buried at the Jewish Cemetery in Nairobi on September 24th, 2019.

A month before his death, Cohen had reportedly complained of harassment and denial of his conjugal rights by his estranged wife.

I remember when DPP ,Haji took the reins,he sounded authoritative, resolute,and uncompromising. First forward to today... He looks and acts like a dog with a tail between its legs.So docile.
It has been almost 4 years since the heinous crime was committed.Iam not advocating for rush to judgment,but what have they been doing. For Pete's sake, this is a murder case.A serious crime.What's going on with so many high profile cases being withdrawn? Let's here for the LSK,the law scholars.

DPP needs to be replaced.
It is obvious Haji is the problem.

There will never be enough evidence for Haji to prosecute some of these cases.

Money talks . Haji must be a billionare by now. but withdrawing murder cases pre-maturely is a sin it is against all ethics. Haji is not acting alone and it might be it is not about wairimu but the judge who collaborated with heris being protected. Holy shit is where Kenyans are walking on .Let us now wait what Koome will decide. The Dutch ambassador must protest . Netherlands know how to fight for their own and don't forget they give so much funding to Kenya including scholarships but regardless it is about a human being like you and me

Haji needs to be fired faster. You cannot drop cases of the rich and famous like that. Where is Raila to call mega streest demo? Open Kamiti & Naivasha prison for all to walk free. It is so unfair to do this. Bonoko government.

HOLY SHIT. first politicians cases withdrawn including murder , theft name it . but this one is not comprehensible . How much dinaros changed hands i wonder? In Kenya there is no justice. no credibility wairimu enjoy your riches . hell is not when we die but right here

It is amazing what corruption money can do. This foolish dpp is withdrawing every dirty case after receiving huge bribes. Haji really missed a corrupt government to be in place.

@ comrade Kora Kanini, let me think.Meanwhile, let us find Raila and tell him this is urgent. He needs to mobilize his forces, match to Haji's office to demand why all these high profile murder cases are being withdrawn left and right. He should drop the other useless match/protest on the 4 commissionners.And if he succeeds, he might just get my vote...

@ comrade Kora kanini, I magine what is going on in the minds of common men and women who are in jail accused of the same crimes-murder. Some even charged under unclear circumstances that could be adjudicated either way.
Ruto is silent, his DP is silent, the clergy is silent, RAO is silent, lawyers are silent.Who is speaking for the voiceless?Where is justice.Should we call for the return of Mzungu?
RAO may have had apoint when he requested for FBI and scotland yard to investigate some of the injustices seen in Kenya.
What is so hard to just follow the law,and give justice to all without prejudice? Comrade,this calls for a bottle of whiskey.
