Woman Sentenced for Withdrawing Sh271,000 Mistakenly Sent to Her via MPesa

A woman has been ordered to pay a Sh200,000 fine or serve a two-year prison sentence for stealing Sh271,000 sent to her via MPesa by mistake.

Elizabeth Karimi Muthoni, a businesswoman based in Nairobi, was presented before Kibera Senior Principal Magistrate Philip Mutua.

The accused person admitted to withdrawing a total of Sh271,200 that was erroneously wired to her MPesa agent account on July 14th this year.

The court heard that Bakar Hussein Mohamed was buying an MPesa agent account when he mistakenly sent the float cash to an account belonging to Muthoni, who operates an MPesa shop in Kitengela.

Kenya Commercial Bank (KCB) tried to reverse the transaction, but the money had already been withdrawn.

While pleading guilty to theft charges, the accused told the court that she had only withdrawn part of the money and that she was in negotiations with Bakar for a refund.

Magistrate Mutua slapped her with a Sh200,000 fine, failure to which she would serve a two-year prison term.

She stole Sh271,200 and the fine is sh200,000 which means she profits with sh71200. Who is the winner here? This judge seems to have been compromised.

I was wondering about the same thing. Could the Sh200,000 be a sin tax to the state for theft or will the suspect be required to make restitution? Hebu niambieni wakenya wenzangu.

who says 2 years in jail equals fine for Sh. 200K? someone please show me how these judges do these complicated calculations? why not say 3 3weeks or 7 months or 5 years? I come to believe they just guess a lucky number and so becomes their ruling. the justice system is just like the old barter trade system, needs true reform
