Miguna Miguna Dares CS Matiang'i to Appeal Friday High Court Ruling that Awarded Him Sh7 Million
Deported Kenyan-Canadian lawyer Miguna Miguna has expressed confidence that the Appellate Court will rule in his favor should the government decide to appeal Friday's high court judgment.
Reacting to reports that the State is considering appealing Justice Chacha Mwita's ruling, the self-declared National Resistance Movement (NRM) general has dared the respondents to try it.
“Let them try," Miguna says, adding that the higher court will increase his compensation for illegal deportation by 200 percent.
“The Court of Appeal will increase my damages by 200%. Let them try. They will not win on earth, in hell or in heaven! #SayNoToUjinga,” he adds.
In his ruling, Judge Mwita said that the firebrand politician was unlawfully deported and that he didn't lose his Kenyan citizenship by acquiring a Canadian passport.
“…The government’s deduction to cancel Miguna Miguna’s passport and declaring him prohibited immigrant is unconstitutional and is hereby declared null and void.” reads Justice Chacha's ruling.
“I find and hold that he did not lose his citizenship upon acquiring a Canadian passport."
The court also ordered the respondents, Interior Cabinet Secretary Fred Matiang'i and Immigration Principal Secretary Gordon Kihalangwa to pay Miguna Sh7 million as compensation for violation of his rights.

You can't lose Citizenship By Birth.
You can renounce your citizenship by birth but you can't lose it.
The government cannot revoke your citizenship by birth.
They can revoke other citizenship status but not citizenship by birth.
This Jubilee government has been lying to Kenyans in Diaspora.
Miguna is just exposing their lies.

Many many Kenyans who acquired foreign citizenships prior to the 2010 constitution have been forced to reapply afresh to restore their Kenyan citizenship, myself included. Why do you keep wanting to make an exception for Miguna?

That decision can be appealed by any Kenyan not necessary Hon. Matiangi. This is a national security issue and it affects all Kenyans. This are issues I wish people Dr. Koni Hanene would step in and file an appeal. Terrorists should not be rewarded with citizenships and monetary awards after committing horrific crimes. Corrupt Judge Chacha Mwita is setting up unprecedented course in Kenya's legal system. Terrorists are not celebrities and never will.
