Mois Son Seeks to Block Sh90 Million Payout Order to Ex-Wife

Former President Daniel Moi’s son, Philip Moi, is seeking to stop an order requiring him to pay his estranged wife, Rossana Pluda, Sh90 million.
Mr Moi wants a stay of execution of the judgment of Mr Justice Luka Kimaru to enable him to appeal against the decision.
Through senior counsel Tom Ojienda, Mr Moi submitted that he risks being committed to jail and his liberty curtailed because he cannot pay the total amount.
“Ms Pluda, being of Italian origin and under no restriction of her movement, is unlikely to be in a position to repay Mr Moi the entire amount as ordered should the Court of Appeal overturn that decision. That is why the payment should be stopped until the appeal is finalised,†said Prof Ojienda.
LUMP SUM MAINTENANCE
He said Mr Moi is willing to continue paying Ms Pluda Sh150,000 per month as maintenance when she is alone and Sh250,000 per month when she is staying with their two children so long as the order requiring him to pay her Sh90 million is put on hold.
Justice Kimaru on March 10 ordered Mr Moi to pay Ms Pluda a lump sum maintenance of Sh30 million within 90 days.
He also ordered the former President’s son to provide his estranged wife with a house in Runda, Lavington, Kileleshwa, Kilimani, Karen or any other upmarket area of Nairobi, or alternatively pay her Sh60 million within 90 days of the judgment.
Justice Rose Ougo certified the application as urgent and directed that it be heard inter-partes on April 16.

Many poor folks are poor coz they are lazy and have no clue what it takes to amass a substantial amount of wealth. Here in the U.S. they include millions living off the dole system (welfare) ever supporting legislation to hike taxes for the wealthy. Back in Kenya, and on this column (by some in the diaspora), they are fall ing on each other urging Moi to pay! Anybody who has been on the very treacherous journey to amass even a small fortune appreciates other people's property and is not quick to belittle the property owner's time, energy, sweat n sleepless nights that describe such efforts. This Court is targeting Philip simply coz he's the son of a former president. Finally, it's always a good idea to avoid gold diggers before they bring you down
