Mungu Anawaona: Senator Kihika Laughs Off Claims That She is Not a Kenyan Citizen

Nakuru Senator Susan Kihika has reacted to a petition seeking to block her bid for the county’s governor seat on grounds that she is not a Kenyan citizen.

A petitioner named Joseph Kimani Njuguna wrote to the Independent Electoral and Boundaries Commission (IEBC) and Ethics and Anti-Corruption Commission (EACC) claiming that Kihika renounced her Kenyan citizenship in 2003 and then acquired America citizenship.

Njuguna wants the electoral commission to disqualify the senator from the Nakuru gubernatorial race and bar her from running for any public office.

"Susan Wakarura Kihika is a citizen of the United States of America. She acquired the citizenship by renouncing her Kenyan citizenship in 2003. She is therefore not suitable to vie for any seat," the petitioner says.

“Having lost her Kenya citizenship, the said Susan Wakahura Kihika was required under section 10 of the Citizenship and Immigration Act Cap 172 of the laws of Kenya to apply in the prescribed manner in order to regain citizenship of Kenya.”

He argues that Section 8(4) of the Citizenship and Immigration Act makes it an offense for dual citizens not to disclose their other citizenship in the prescribed manner.

The petitioner adds that Kihika, though not a Kenyan citizen, has held the positions of Nakuru County Assembly Speaker and senator, hence contravening the Constitution.

"I contend that she became Speaker, senator and is now seeking to become governor in contravention of the Constitution and other statutory provisions of the law. I, therefore, request that Ms Kihika be barred from contesting the upcoming general election of August 9, 2022 in the position of Governor Nakuru County.”

Kihika scoffed at the allegations, wondering why the citizenship question is emerging now and not when she contested for the Senate seat in 2017.

"Soo....As a Senator I was Kenyan but now that am going for Governorship am not Kenyan. It's all right; Mungu anawaona," Kihika wrote on Twitter.

"When they sense defeat their desperation knows no limits," she wrote in a separate post.

Most of the things we do on this earth, God has given us tools to uses.Much like he said go forth and multiply.And surely we know very well how to multiply.The current world population is about 8 billion people,and Africa proudly claims about 16% of that. The strange about all this nonsense with Susan trying to hoodwink Kenyans is that she must have prayed very hard to get the US citizenship. Now she is calling upon God to help her after He had already helped her in the first place. Hawa watu think Kenyans are stupid.

Whether she's a US citizen or not, there's Duo-citizenship between Kenya and the US. So she has the Right to Run for any Seat in Kenya. Wacheni ujinga? Wivu, Siasa zisizo na Muelekeo. And who wouldn't want to be a US citizen Come what May?

Your argument would have sufficed only if you’d have done some research and found that Kenya only approved dual citizenship in it’s 2009 constitution!
She denounced her citizenship in 2003……..well before the new constitution!!
Henceforth, she’d have been required to reapply for dual citizenship status!
I think she didn’t because she was afraid that she’d look like a sellout at her first running for office! Now, the chickens have come home to roost, and she’s right that only God can save her because the constitution isn’t on her side!!

We give special treatment to our politicians - she doesn't need to comply with immigration law, cause we adore her so much - yet if you visit her executive office and one tiny detail about you as a constituent is mismatched they wouldn't serve or see you.

For those unfamiliar with the current constitution of the Republic of Kenya. Once you attain US Citizenship you have automatically renounced your Kenyan Citizenship and therefore you must reapply to become a Kenyan citizen. Kwani mmekuwa mkilalia masikio yalipomtendekea ndugu Miguna na Mwende Mwinzi (although yeye alipenya, whatever she had to do- mimi kusema ukweli sijui wink wink)😉. This also applies to those Kenyans who have American children. Usijipate kwa mataa.. Read the constitution very well. Ukitaka kazi ya serikali Kenya heri ubaki kuwa permanent resident. Nimeona wakenya wengi sana wamemakinika hawakimbilii US citizenship ovyo ovyo

This is a quote lifted directly from the Kenya constitution. Chapter 3, Section 16.
Dual citizenship.
16. A citizen by birth does not lose citizenship by acquiring the citizenship of another country.
Where are you getting your information from? Following the 2010 constitution, you do have to alert serikali within 90 days of attaining another country's citizenship. Prior to 2010, you lost your citizenship but can now reapply if you were one by birth, i.e. people like myself and yes MigunaX2.

Ms Kihika was a lawyer in the USA! Only USA citizens are allowed to practice law in the USA!
It’s true she became a US citizen on or around 2003! At that time, it was illegal, in Kenya, to hold a dual citizenship!
Henceforth, she had to renounce her Kenyan citizenship at that time!
In 2009, Kenya ratified a New Constitution, with a provision that allowed for dual citizenship!
However, the law is VERY CLEAR that those who had denounced their Kenyan citizenship prior to the ratification of the new constitution needed to apply to gain it back, at the liberty of the Kenyan government!
Ms Kihika may have intentionally skipped this process because she was afraid of the negative publicity it would bring at a time when she was seeking public office!
Nobody thought to bring it up then, but now the chickens may have come home to roost! She can’t claim ignorance because she’s a lawyer by training!
She’s right! Only God can save her!

Nonsense. US does not require those it awards citizenship to renounce native citizenship. And if it did, even those becoming citizens of the US after 2010 would have been required to renounce Kenya citizenship.
