Parents Cannot Sue Schools for Punishing Ill-Behaved Students, Chief Justice Martha Koome Says

Chief Justice Prof. Martha Koome says that parents cannot sue teachers and schools for punishing ill-behaved students.

Koome warned parents who go to court after their children are suspended or expelled for breaking rules that such cases will be dismissed and they will be responsible for the costs.

Speaking on Monday during Thanksgiving and Form One Welcome Mass at Loreto Limuru Girls' High School in Kiambu County, the Chief Justice stated that all forms of indiscipline cannot be tolerated and called on parents to take responsibility for raising their children in a moral way.

To ensure that children are fully protected, Koome proposed an improvement to child protection laws, warning that any suspects found guilty of child abuse will face a sentence of at least 20 years in prison.

"We do not encourage indiscipline at all we have the obligation to bring up our children, to encourage them, support them. Whoever violates a girl child or a boy child will be imprisoned for 20 years to pay for the pain and the agony that they caused the victims," said Koome.

Her sentiments were echoed by Deputy Chief Justice Philomena Mwilu, who challenged parents to get involved in the upbringing of their children and create ample time to spend with them. 

"And if you're not part of your child's school, anything else you'll do will be in vain. When you are part of your child's life and you take active participation in school, you will just marvel at the success of your child," noted Mwilu.

I beg to differ with Chief Justice. Schools are NOT jails and Corporal punishment conveys the wrong message to children and can cause serious physical and psychological harm to a child. If Corporal punishment if directed at an adult it would constitute criminal assault. One of the most basic human rights principles is the right to live free from the threat of violence and this principle applies in school too!

Warning Schools! You are NOT correction facilities! If a teacher injurers my child while trying to discipline it since you now have a green light from Chief Justice I am taking you to Qadhi court and you will be Judged according to Islamic Sheria laws in which case your hand could end up being chopped off or worse still I could declare intifada on you in which case you would face my wrath outside school premises(if it's a man that mean pinching your balls). Do Not Mess With Yusuf Kids Schools!

Are Koome and corrupt Mbete dismissing pending cases and those not yet filed in courts?Their loose talk will result to parents revenging for their children which puts teachers at a very dangerous position.They should have explained why Mbete is still in office with pending tax-evasion cases against her.

We have rogue parents and teachers. Gova should come up with guidelines on how and when to discipline students. In the meantime if you as a parent feel the discipline instilled is no good for your child, please take them home with you do not indulge teachers in endless court appearances. Teachers are working hard already and not getting paid enough!

C.J should clarify her statement i cannot agree my child to beaten the way i was beaten at school. the teachers were more than animals. I think cj should revisit her statement
