'Kenyan Parents in USA' President Opposes Petition for Miguna Miguna's Return

D. K. Gitau, President of Kenyan Parents in the USA, has come out to oppose the signing of a citizen petition to pressurize the government to allow  Miguna Miguna back to Kenya. 

In a statement, Gitau faulted Miguna’s bid to travel to Kenya using a national identity card, noting that a national ID cannot be a substitute for a passport for international travel by air.

“People lose passports and apply for another one (sic). This loud mouth wants us to sympathize with him by mentioning court orders which are against the constitution and only have meaning to few (sic) people,” noted Gitau.

He wondered why it is hard for Miguna to visit the Kenyan High Commission in Canada to apply for a new passport as advised by the government, like other Kenyans in the Diaspora do.

“Can the learned friend Mr. Miguna Miguna approach the High Commission in Canada to apply for dual Citizen as we are all bound by the 2010 constitution? If the High Commission refuse (sic) to process his documents, then we can sign the petition. We need to see a valid Kenyan passport and not the shredded one as it has already expired,” he added.

“That is all the Government wants to facilitate his return as per court order. No human travels with an ID on an international flight. Its (sic) E-passport as regular ones WILL EXPIRE this February.”

Miguna was earlier this week forced to travel back to Canada after airlines declined to fly him to Kenya from Europe due to a red alter allegedly issued by the government of Kenya. The alert reportedly warned airlines against ferrying Miguna to Kenya or any other African nation.

The government insists that Miguna must first acquire a Kenya passport from any Kenyan mission abroad if he is to be allowed back into the country.

In Legal jargon, this is what is called 'locus standi', or where you are standing, when making a claim. It simply means that one has to have a legally acceptable reason to make a Claim before a Court of Law, and a Court has to have the Jurisdiction to issue any 'Orders' that it issues, according to local and International Law. The main question therefore in this case is not that a Court issued orders, or even if they are being followed or not. It is whether a Kenyan Court can 'Order' the Kenyan Government to go against International Law, regarding one passenger. Mark you, these laws are made by International bodies, such as IATA, and they apply to everyone. IATA is not Subject to Kenyan Law, or 'Orders'issued by Kenyan Judges. If International Laws of Travel are not followed in Kenya, for whatever reason, IATA will take notes, and advise advice it's members accordingly. To make a long story short, Kenyan Law, including Court Orders, cannot be enforced by people, or entities who are not obligated, by International Law, to follow the Kenyan Constitution. Chacha Mwita had no 'locus standi', to issue these 'Orders', and the GoK has no 'locus standi', to enforce them. Chacha na Miguna wote wanabweka bweka.

Ps, it does not matter the reason that Miguna Miguna does not have a Kenyan passport, according to International Law. They don't care. According to this law, he is not a Kenyan citizen if he does not have a Kenyan passport. A Kenyan Judge has no power to change International Law.

I am also a Kenyan Citizen by birth, but I cannot be allowed to board a plane outside Kenya without a passport, and I cannot be allowed to enter Kenya using my Kenyan ID, because JKIA follows International Law, for all Passengers arriving there, including Kenyans by birth. Miguna is no exception, and as a lawyer himself, he knows this. The last time that he was deported was simply because he refused to give the passport that he was traveling on (read Canadian passport), for it to be Stamped at the Immigration Counter. Since he did not provide a passport, he had to be given back to the Airline that brought him to Kenya, because they are the only ones who knew the document that he used to board their Aeroplane. Airlines are commercial entities which are not Subject to Kenyan Court Orders. They are there to do business, and are not interested in Miguna's Shenanigans. I think that there is a misconception that Miguna can argue his way out of his predicament. He cannot. He has to apply, and get a Kenyan passport, before he is allowed back into Kenya.

These groupings are led by “shiny” briefcase carries who exploit the problems in Kenya for their own stomaches! It is time to call the groupings what they are and tell Kenyans the kind of menace they pose to their wellbeing!

The leaders of these groupings live overseas, nearly all of them. Time to time they return to Kenya to vacation in 8 star hotels, while eating Kshs 5,000.00 per plate of breakfast, lunch, dinner plus some golden snacks.

They never visit Kenyans upcountry to find out how Kenyans live, find out the current needs and cone up with tangible solutions while there on the ground. These grouping only want to have audience with the corrupt politicians so they can find a nest egg in the 47 counties.

These folks only want to be seen standing next to “that” big name so they can have “headline” in media houses across the globe telling lies what they are doing to alleviate poverty, disease, ignorance, corruption, etc in Kenya, while in actuality, their intent is seek big cash donors to fatten their bank accounts overseas.

They write imaginative reports on various topics and then publish them to the world, but never come up with any tangible solutions to the minutest of the solvable problem. Sone if the problems they write about are of their own creation!

These diehards are now starting phone “groupings” so that they can “stage manage” political come back in their constituencies back in Kenya come 2022!

Next you will hear Ati, Kiama Kia GUI, kiama kia Funda, Kiama Kia Nyau, Kiama Kia Nguku, Kiama Kia Mburi, Kiama Kia Thugura, etc have been started.

We are told all these “ fraudulent groupings” need elected representatives in Kenya parliament. Then you find that those starting them are the only once running for those positions at the expense of ordinary Kenyan tax payers.

These folks are pure Kenyan black neocolonialists, frauds, and experts of conmanship whose entire intent is to exploit Kenyans back home.

Kenyans beware of fraudsters with “shiny” tools to blind your simple reasoning capacity! Kenya’s problems must be solved inside Kenya and not in some high-rise building in some place overseas!

Like Miguna I live in Canada and have personally met Miguna here in Toronto in a shopping mall. Miguna is a very nice person and he was at the mall with his son. Like a fellow kenyan brother...actually he called me sister... we talked but no politics. We talked about kids; weather and even exchanged phone numbers and took a selfie. I almost; almost asked Miguna why he likes to cause trouble for no reason at all. Like him I lost my Kenyan citizenship when I became a naturalized Canadian. When I travel back home I use my Canadian passport and apply for a 3 month Kenyan visa at the airport and I pay 50 USD. It takes minutes for immigration officials at JKIA to stamp the Visa and they are professional and friendly. I have my Kenyan ID and I would be crazy to present that ID as a travel document. Miguna is highly educated...those high court judges in Kenya are aware that even diplomats travel using diplomatic passports but they cannot use IDs at any international port of entry due to IATA laws. I will never understand why Miguna is doing this to himself and mostly to his children. What example is he setting to them? He can either go get a new kenyan passport or use his Candian passport very easily to go to Kenya. I cant say anything bad about Miguna but I wish I could understand why he is putting himself through all these. This is no brainer...if who ever want to kutukana

He obtained it using irregular methods. That is why it was taken away. Just the same way you would lose your US citizenship if you were not truthful. You know damn well that a lot of GoK offices are populated with corrupt people. As for us insisting he regain his citizenship just like ordinary raia (why is he special?), it is in our new constitution. Work on changing it if you must but it was ratified by a 2/3 majority. Kenyans in Kenya passed it and the minority living comfortably in the diaspora need to work with the majority to change it if they are dissatisfied. It may not be fair but it is in the constitution. Why does he get a pass and what part of the constitution should we ignore when we don't like it? FYI, I don't like it but I still followed the law. Lastly it was his choice to plan poorly and spend obscene amounts traipsing through Germany making noise. I'm sure the Kenya courts are icons of moral probity and virtue and their rulings are never tainted by corruption. I'll ask you this, if I illegaly gain access to your property, which you then seize from me, and then a judge known for siding with the corrupt, rules in my favor for no good known reason, would you be ok with it. Before you say it's not the same thing, remember the passport is and remains the property of the issuing authority, in this case the GoK. It may be revoked and recalled at any time in Miguna's case because it was obtained irregularly-read criminally. Miguna is stuck in Germany or somewhere out there because no airline will allow him to board without proper documents.As someone said he can get to Kenya with a Canadian passport and apply for a Kenyan visa.He is being stubborn that he must travel with a Kenyan passport.He does not want to apply for a new one at the Kenyan embassy in Germany .International airlines are not bound by a Kenyan laws therefore the ruling by some Kenyan judge that he must be allowed entry is mute.If other Kenyan Canadians or is it Canadian Kenyans have travelled to Kenya and applied for visas on arrival what makes him special?Furthermore those who are signing a petition are wasting their time so what even if you gather 500 or 5000 signatures will you compel the airlines to issue him with a boarding pass or have the Kenyan government hand deliver him a new passport to wherever he is hooled up in Germany.Look at the Hong Kong demonstrators they have been going on for months the government does not give a rat’s ass who is Miguna in Kenya mtangoja.

Where does David Komen live if he does not know what is a valid passport. I will explain to him the last time. After attaining citizenship of another country, your passport is no longer valid. We do have the same passports but after the 2010 constitution they became void to dual citizens. That is what we are presenting to BBI to remove that clause. You have to regain or declare and then get a dual citizen passport. Many have complied but Miguna refused even after the forms were taken to him at the airport, and he tore them to pieces and insisted to enter with ID. The passport with the court is null and void and cannot be used for travelling. Those are the regular passports and they will no longer be used after February. You must get epassport and its not a Kenya Government rule but IATA rules. Calling me names without fact will not help. When i studied 6×6 matrix equations at University in 1975 David you never existed or if you did you were a toddler and calling me names is like a child insulting the father.Give me a break am no fool but a genius.

The govt took Miguna’s Passport (the Executive arm of the government, ) another arm of the government (Judiciary has issued Court Orders for Miguna to be facilitated back to the government with whatever form of identification he has.
Miguna is Kenyan and the government need not put any obstacles for his home coming.

I went to school with people who were Kale, Luo, Kisii, Luhya, Kamba, Goan, Wahindi, WaSwahili, Kuria, Somali, mTanzania, an Amhara, a Malawian by way of Uganda. My first roommates in the US were Maragoli and Kisii. I was born in the shadow of Kenya.
