Three Kenyans Sentenced to Death for Stealing Sh3,300 from Taxi Driver

A Kerugoya court has sentenced to death three suspects accused of robbing a taxi driver of Sh3,300.
The three; Josphat Njoroge, Hilda Njau and Mikeson Mutinda were found guilty of robbery with violence.
They were charged that on October 5th, 2016 at Kabendoso area in the outskirts of Kerugoya town, while armed with crude weapons, they robbed Ibrahim Mwangi of Sh3,300.
In the second count, the suspects were charged with attempting to rob Mwangi of his motor vehicle, a Toyota Fielder worth Sh900,000, while armed with knives and using actual violence on him.
Mwangi narrated to the court how Njoroge and Hilda approached him at the taxi parking in Kerugoya town seeking to be driven to Kabendoso area to purportedly view a parcel of land that was on sale.
A few meters from the said land, the two asked him to stop as they had seen the owner of the parcel.
“But on stopping two other men boarded the vehicle after which I immediately developed a hunch that I was in serious trouble,’’ Mwangi testified.
He recalled how Njoroge and Mutinda grabbed him before strangling him using a rope as Njau pointed him with a knife.
He also said Njoroge and Mutinda tried to push him from the steering wheel with the rope tied around his neck.
“Luckily an oncoming tractor driver sensed trouble and blocked the road as I screamed for help at the top of my voice,” he said.
This attracted the attention of members of the public, who arrested the suspects. Police officers arrived on time and saved the suspects from being lynched.
In his ruling, Senior Resident Magistrate Eric Wambo says: “Since you have declined to show an iota of remorse even after being accorded the opportunity, I hereby sentence you to death as prescribed by the law and accord you 14 days within which to appeal."

Marley is correct. Robbery with violence attracts Death by Hanging in Kenya. I applaud the judge for applying the correct penalty for the crime. The value of stolen items is immaterial and irrelevant. Billions stolen by politicians is a separate matter.

Robbery with violence as described here is much more serious than economic crimes. An innocent hard working Kenyan was just about to get killed. I agree with you @Maxley, this might be the only judge in Kenya who is doing his job properly according to the law. Sad that most of those commenting here cannot see beyond the 3000 bob. Others have this bad habit of reading only the headline and start commenting.

Section 296 (2) of the penal code is very clear on the punishment for robbery with violence:
"If the offender [person who commits the felony of robbery] is armed with any dangerous or offensive weapon or instrument, or is in company with one or more other person or persons, or if, at or immediately before or immediately after the time of the robbery, he wounds, beats, strikes or uses any other personal violence to any person, he shall be sentenced to death"

Though it sounds outrageous to Kenyans who see massive theft by elites everyday, the law provides for the death penalty for robbery with violence. What Kenya should do now to bring fitting punishment to all looters is to pass death penalty for grand corruption.
