Why Faith Odhiambo Left Ruto's Team on Protest Victims Compensation

Faith Odhiambo, President of the Law Society of Kenya (LSK), has resigned from her position as vice chairperson of the government-appointed panel on compensation for victims of state excesses. 

Her departure follows the suspension of the panel’s work by the High Court, leaving its mandate in doubt. In a statement released on Monday, Ms Odhiambo cited the court order halting the panel's operations, which rendered it impossible to meet its objectives within the stipulated timeframe. 

The panel, established to address the compensation of victims of demonstrations and public protests, had been given a 120-day mandate, but its activities are now frozen. Ms Odhiambo noted the growing frustration among victims who continue to seek assistance while the panel remains inactive.

Her resignation comes amid growing controversy over her role in the panel, which was formed by the government in late August. While the initiative was presented as a step toward accountability for police actions during recent protests, questions about its legitimacy and independence quickly arose. 

Civil society groups argued that its formation bypassed constitutionally mandated bodies, such as the Independent Policing Oversight Authority, raising concerns about its legal foundation. Internally, Ms Odhiambo's appointment triggered significant opposition within the LSK, with several council members voicing concerns that her involvement compromised the society’s autonomy.

Initially, Ms Odhiambo defended her participation as a way to influence reform in victim compensation processes, but the LSK later concluded that her role in the panel conflicted with the organisation's mandate to remain independent. The suspension of the panel’s activities has further intensified scrutiny of both its purpose and its formation. 

Ms Odhiambo’s resignation appears to be a move to protect the LSK from potential reputational damage and political entanglement. She emphasised her commitment to preserving the society’s independence, stating that her oath of office required her to shield it from external pressures.
