Gachagua Vows to Sue Over Claims of Unpaid Ksh 25 Million Nairobi Apartment

Former Deputy President Rigathi Gachagua has threatened legal action against a property company over claims that he unlawfully facilitated the occupation of a Ksh25 million apartment by a female associate without payment.

In a formal demand letter, Gachagua’s lawyers deny any connection between their client and the property in question. They state that Gachagua has never visited the premises nor been involved in any related transaction. 

The letter demands a full and unconditional retraction of the allegations, along with a written apology published in two national newspapers within 24 hours. If the demands are not met, the legal team warns of immediate defamation proceedings.

The property firm, through its legal representatives, had earlier accused Gachagua and the woman alleged to be living in the apartment of unlawful occupation. The company demanded that they vacate the premises and provide compensation based on the current market value. 

It also threatened to recover its interests through legal means, including the auctioning of items found inside the apartment. Gachagua’s lawyers have criticised the claims as false, defamatory, and widely circulated across media platforms. 

They argue that the allegations have damaged Gachagua’s personal and political reputation and were made recklessly, with full awareness of their inaccuracy. The legal team cites provisions under Kenya’s Defamation Act (Cap 36) and Article 33(3) of the Constitution, which limit freedom of expression when it harms the rights or reputations of others.

The dispute arises amid ongoing political uncertainty surrounding Gachagua, who has recently faced speculation over his relationship with President William Ruto. While the apartment matter is presented as a private legal issue, it has the potential to influence public perception ahead of the 2027 General Election.
