Ichung'wah Threatens to Sue Lawyer Omari for Withdrawing Defamation Suit

National Assembly Majority leader Kimani Ichung'wah has communicated his plans to sue Lawyer Danstan Omari for withdrawing a defamation suit against him filed at the High Court.

Ichung'wa's lawyer Cecil Miller through a demand letter delivered to Omari, claimed that the case is currently in magistrate court after its withdrawal from the High Court. Omari had sued Kikuyu MP Ichungwa for his tweet that the former visits Koinange Street. In this case, Omari requested sh11 Million.

However, Justice Visram Aleem Alnashir transferred the matter to the magistrate court on April 26 on the grounds that the case is a defamation issue.

“This being a defamation matter, I direct that the same be transferred to the Chief Magistrate court for further directions” the order reads.

After the transfer, Omari's lawyers withdrew the court from the High Court on April 27 and filed the case at the magistrate's court which has since ordered Ichung'wah to make an appearance in the suit or the ruling will proceed without him. The case at the magistrate's court will be heard on June 26.

The majority leader through a demand letter to Omari gave Omari seven days to reinstate the suit that was previously at the High Court failure to which he will sue him for defamation.

“We demand that you reinstate the suit within seven days from the date herein to allow our client to have his day in court or you inform the media that you withdrew the suit against him upon which we shall address you on the issue of quantum of damages payable to him,” the letter reads.
