Kenyan Man Sues His Son Demanding 20 Percent of His Salary as Upkeep

A 73-year-old Kenyan man has sued his son demanding part of his salary for his maintenance.

Gideon Kisira Cherowo, a resident of Biirunda in Trans Nzoia County, wants the court to compel his son to remit 20 percent of his monthly pay to him as upkeep.

In an application filed at Kitale High Court, the man accuses his son Washington Chepkombe Cherowo, 48, of abandoning him and the family despite funding his education until university level.

“I used all the resources I had to enable the defendant to be in a good position so that he can help us. Right now, my wife and I are in a horrible state yet we have a son who is working. I pray that since the defendant has a good salary, I request for 20 percent of his salary to be given to me as the father,” he says in court filings.

“I sold my land in Cheptais, Bungoma, to educate him from primary to university. I also gave him a quarter of an acre. I even went ahead to pay a dowry for the defendant’s wife, which cost me four cows and some amount of money, whose sum I cannot recall.”

Cherowo says Chepkombe, who works at Kenya Airports Authority (KAA), does not send anything to the family.

The father of four has attached a witness statement from his son David Masyek, who agrees that his brother should surrender part of his salary to their dad.

“The defendant deserted his parents after he got a job. It is now 17 years since we saw him. He does not come or send any assistance to us. We are leading a very horrible life after the defendant consumed the very thing our father had, so as to take him to school,” Masyek says.

Among his four children, Cherowo says Chepkombe is the only one who is gainfully employed.

Mzee may be your son is earning below minimum wage which make it very difficult to make ends meet. May be he is keeping away from you because you are demanding money which he does not have or cannot afford.

PARENTS, PLEASE DON'T THINK KIDS ARE INVESTMENTS. I'M SORRY TO SAY THIS.
We all understand that our parents do love us, but we also have families of our own. We need to help when need be, but should not be forced.
KIDS LET'S USE OUR CONSCIOUS AND COMMON SENSE ALSO.
WHAT HAPPENED TO OUR MORALS??

Well said @ Kora Kanini, I would hope that there are very ,very few parents who look,or give birth to children with the hope that the kids will be their tickets to financial comfort.
Parents should do their very best to bring up children that will make good citizens.Iam sure no parent would want their child to be a prostitute, a murderer ,or athief,even though some would want their children to be financial thieves like the Mpigs,but not to be caught.
The only thing kids own their appreciation for their parents'sacrifices,is respect, love,and un pressured financial assistance if their are able.
I am also mindful that some parents are horrible,and put their kids like through hell.With that kind of strained relationship, it would be hard not to remember such parents,even if they financially made you comfortable.
To me, money should be the least a parent should demand,or expect from his children.With love, respect,and good morals,the rest is easy.

What a terrible situation? Banking on a son to support the old man is fairly far reaching! The father and the son should discuss the issues and settle this matter amicably. A child shouldn’t be compelled to support the father!

I disagree here kindly where possible saidia parents..he paid hata dowry for you since you are learned basics like turning their small farm to good production buy kangombe ya maziwa kuku zitage mayai few things will make them comfortable hata 1k monthly ya sukari..The Govt too pesa ya wazee ilienda wapi? ifikie uyo mzee..machozi ya mzazi sio poa.

I have never heard of a law compelling children to fund their parents lives.But I just wonder the amount Chepkombe will spend in his parents’ burial.Does he know that he might expire before them?It’s better if you give your parents ka-something when they are alive.
