Reprieve for Deputy Chief Justice Philomena Mwilu as High Court Stops Criminal Proceedings

Deputy Chief Justice Philomena Mwilu has been granted a temporary reprieve after the High Court issued orders suspending criminal charges against her.
The orders were issued on Wednesday after Mwilu filed an application in the High Court seeking to block her prosecution.
While issuing the orders, High Court Justice Chacha Mwita said Mwilu's application raised significant questions that need to be addressed.
Subsequently, Judge Mwita set October 9th, 2018 as the hearing date for Mwilu's application to stop criminal proceedings against her.
In her petition, Mwilu, who is the Judiciary Vice President, names Director of Public Prosecutions (DPP) Noordin Haji, Director of Criminal Investigations (DCI) George Kinoti, Attorney-General and Chief Magistrate of the Anti-corruption court as respondents.
Parties in the case have been directed to file their responses and appear for inter-party hearing on the said date.
Mwilu filed the petition on Wednesday morning through lawyers Nelson Havi, Harun Ndubi and Okong’o Omogeni.
Mwilu was arrested at the Supreme Court on Tuesday afternoon and was arraigned in court in the evening where she was charged with abuse of office, forgery, tax evasion among others. She was set to take plea on Wednesday morning.
She is accused of using her office as a Judge of the Appellate Court to improperly confer a benefit of Sh12 million to herself at the collapsed Imperial Bank Headquarters in Westlands between August 15th and October 23rd, 2013.
The Lady Justice is also facing accusations of unlawful failure to pay taxes to the Kenya Revenue Authority (KRA). The charge sheet shows the instances of failure to pay taxes were separate land purchases worth Sh3.1 million, Sh58,000, Sh2.4 million and Sh3.6 million.
She is also charged with uttering a false document and forgery contrary to different sections of the Penal Code.

What kind of mickey mouse justice is this. What does a retrieve mean to the rest of us. If there are evidence of wrong doings then it should be up to a judge or a jury to hear the full case. This business of letting people out of the custody and never to hear of the deposition of the case is a big joke. Too many thieves in the government and the judiciary appears to be among the most corrupt element in this dirty business. It is business as usual when it comes to public corruption. Too many crooks among public employees. They should held accountable. Charge, indict, convict and jail them.

"Reprieve?". No one should be given Reprieve and especially if you are a high Court judge. Philomena Mwilu should have the courage to face a public hearing to clear her name if she believes she has done nothing wrong. She should not be allowed to block anything. Give every criminal a path to be able to block their own prosecution as this is the new trend and show where the Constitution says that this is possible. The public is watching. What kind of leadership is this. Why should anyone pay taxes? Everyone who evades taxes should get reprieve? This is the same corruption that was witnessed at the High Court during elections. We have no judicial system. God help Kenya!!

Since the Directorate of criminal investigation says it has evidence that shows: graft, tax evasion and money benefits to Mwilu,contrary to public interest, why would Judge Mwitu give her reprieve rather than allow DCI present its case? I think our judiciary cannot be trusted. It has become a catch and release drama in this handshake corruption fight. Remember the NYS thugs, some cabinet secretary, governor Ojaamong, governor Kindero etc, where are these cases? The guy selling cat meat was apprehended, tried, convicted and imprisoned for four years all within a matter of weeks. On matters corruption, we're in trouble because our judges are compromised and will do whatever it takes to protect their kind. Corruption will never end in Kenya until wananchi; using their sovereignty, as provided in our constitution-take matters in their own hands. Organize, inform and engage! Show up in large numbers in every court alignment that involves these elites; chant, carry banners and show your disdain for these thieves and their corrupt judges. Do something- it's action time!
