Diasporan Harassed at Artcaffe in Nairobi

On Saturday 10th December 2011 at 2.21pm, I met my Business Partner and Her friend at the Artcaffe in Junction Nakumatt Mall, Nairobi, Kenya. This was my first time to visit this establishment.

My Business Partner and I sat at a separate table from her friend as we were discussing our business.

After an hour, we paid for our drinks and snacks and left Artcaffe. We then went to the basement where I had packed my new Audi A4 to show them some handbags I had brought from London for my Business Partner. As they both looked at them (in my boot), 2 big burly men appeared from nowhere and asked us in very intimidating tones what we were doing. Before I could even answer those 2 KK Security men and a tall older looking Middle East man materialized. At this point I thought that we were either being car jacked or something was very wrong.

The 3 of us were shaken and wondering what was going on, I quickly explained that I was showing my 2 friends my new handbags. The Middle East man asked me to lock the boot and come aside. I did as he asked and my friends were standing on one side of the car and I was standing on the other with the Middle East man.  He explained to me that we were suspected of stealing a hand bag and laptop from Artcaffe and they had CCTV footage proving this.

When I looked at him in disbelief, and asked him if we could go and see the CCTV footage he agreed. At this point 5 more KK Security men appeared and we were frog marched all the way to the Artcaffe. When we got there I demanded to see the CCTV footage, the Middle East man again pulled me aside and told me that I was not a suspect and that it was my business partner’s friend who was. I told him that if that was the case I still wanted to see the footage and that I could not leave them.

After much confusion of whom had the footage, a short Middle East man accompanied by 2 Middle East women came with a laptop and the older tall Middle East man asked us to go to a handbag shop opposite Artcaffe to see the footage.  When we got there, they then refused to show us the footage and told us that we were free to go. The old Middle East Man explained that it was a case of mistaken identity and that the handbag and laptop (which belonged to a tourist) had been stolen on 5th of December 2011.(please note, the 3 of us were not even in Nairobi on this date).

I looked at the elderly Middle East man in disbelief and asked him if he was the owner of Artcaffe, of which he vehemently denied that he was NOT and that he was a shop owner at the Mall and that we was trying to ‘assist’ us and the Artcaffe solve this issue. At this point a crowd of people and more KK Security had gathered round us.

I then confirmed with him again if we were free to go as we were not the suspects and he categorical said YES!

Disgusted and tired of the whole ordeal I asked my friends we leave and file a complaint later for this harassment.

As we approached the main exit/entrance of the Junction Mall, 5 KK Security men, stopped us and told us we were still suspects and that we should wait for the police to come.

I could not believe this nonsense, a Commander appeared in a KK Security Car with 3 other Security guards and blocked the exit/entrance and surrounded us and told us that we could not leave. I explained to him what had transpired in the last 1hour.

He then told me that the Elderly Middle East man was actually the owner of Artcaffe and that he had told the KK Security that he did NOT want Kikuyus (a major tribe in Kenya) in his premises as they are thieves and that he was 99% sure my business partner and her friend resembled the suspects in the video footage.

At this point it dawned on me that my business partner and her friend were not dressed according to the Artcaffe standard and they did not fit the so called urban chic criteria that can afford a meal at the Artcaffe. And I had been left out as I looked the part and drove an Audi A4!

The most ironic thing is that my Business Partner owns a very big NGO in Kenya that is supported by very many affluent people including 10 businessmen whose businesses are listed on the New York Stock Exchange!

To cut the long horrible ordeal short, we waited for 1.30 Hours for the Police to come, the police saw the footage of which they said that it was so unclear that one could not see the faces of the thief that stole on the 5th of December 2011(Please note it was only 1 thief not 3!)

We went to the nearest Police station (Muthangari Police Station) and wrote statements (although the Police insisted I was not a suspect) but I insisted on doing one as I do NOT Trust Artcaffe. The reason is that if the Owner can Lie to us with a straight face what can he do if given the chance???

My friend I urge you to please boycott this establishment that harasses innocent Kenyans, Racist, Classist  and I strongly believe that we do not need foreigners (who we welcome with open hearts) to insight tribal HATRED in a Country that is only getting over the last Post Election Violence as we approach another Election.

Same thing happened to me very recently last week Saturday at Nakumatt junction. i have been a frequent shopper there i think since day 1. Being my neighborhood mall it is my one stop place for shopping and take out.

So on this Saturday evening i chose to live the house at like 5pm and go get my baby sister dinner as there was no one to cook what she wanted.due to the new KAPS parking guys there was too much traffic on Riara road and so it took me about 1.30hours to get till junction. Finally when i was there the guards were very welcoming of me with greeting, small talk and smiles as they went through my (mothers)car a Mercedes Benz C200. Finally i made it to the parking lot and parked my car at the new parking lot on the new wing of the mall. On my to wimpy to make my order a guard stopped me at the stair case and told me that kids were not allowed there for reasons only known to him.i tried to explain to him my motives and my age (21), but he was stern and aggressive and i really wasn't in the mood to argue.

I then proceeded onto Nakumatt where i did all my house shopping.afterwards i decided to go to my car and leave but then 2nd time around a different guard stopped me at the stairs and refused me to go up to the parking lot.he also very stern and rude. He said that as a child i was meant to be home at such hours(8pm) and that this was off limits. I did not have any form of registration on me to prove my age so i had to plead with him to let me go to the parking lot and get my car.

His reasons were that because too many juveniles and young irresponsible kids had been flocking the mall on Saturdays and drinking, being irresponsible,loud,indecent then he was obliged to not let me through. For a moment i was in awes because, one, i am 21 and i was headed to buy dinner and get my car then leave. Second of all, i was armed with household shopping camouflaged in Nakumatt paper bags. Really what else would i have been going to do at the food court with all that.set up camp?

After minutes of this and that pleading they finally let me through to the food court level but i was too tired i just walked straight onto the car park level.funny thing is when they saw me driving out, they had the audacity to try chat me up. Was it not for the car i would hav never made it out of the Nakumatt lot.

I am so tired of this discrimination be it age, sex, skin color, social class etc etc in our country.

please don't expose how obtuse you are on the comment section, which by the way is not mandatory to make use of if you have nothing constructive to say. clearly something is socially wrong at the junction, and since you so obviously cannot see that, as you have demonstrated by choosing to focus on the car make- i tend to think you are part of the very real, BIG problem!!! Next time refrain from giving a piece of your mind- i doubt u have enough to spare.

I can understand her frustration, but she could go easy on the showing off.."my AUdi A4...my friends business on NYSE.." oh please get over yourself an AUDI A4 aint shit!and what exactly is that Kenyan business that is top 10 on the NYSE..if you're rich..it shows..you aint gotta show it! I really hate it when Kenyans go back home and start feeling good for their fellow Kenyans just because they haven't left the country etc.GET OVER YOURSELF..you're prolly discriminated against in that racist London that you live in! the issue here is not my mothers car.it could have been one for hire for all that matters.or i could have even been a driver.thing is i argue from the point of view of the days when am not being a mommas boy and have to commute.me and the other majority of this country.i do not see why just because we don't drive luxury cars or splurge on designer apparel then we are treated like second class citizens without anything to offer.that is where i was coming from.

Wacha Maringo. Before you left for where ever it is you reside overseas you used to go shopping at Uchumi downtown etc. OHHHH  Please tell us how many times this has happened to you overseas and i bet you do not complain about it here! or on other forums. Now this lad who is driving around in his mothers car ( probably stolen... because the mother is on a Business trip ama amenda ushago) is pure nonscence. by the way Most shoplifters usually come dressed to kill in such establishments, drive around in seemingly expensive cars( mainly thier parents' mot mots)



Summer bunnies are in Nairobi flossing to death... next time you come across one ask them how much the owe on their credit cards.



As for discrimination ... that is a worldwide phenomenon and how you deal with it is what counts... it will happen to you again...

I once had a business meeting at Art Caffe Westgate, walked in and was looking around for somewhere to sit. This white lady walks up to me and asks me f I was looking for a job. I looked her up and down then told her I was there for a businss meeting. Who welcomes guests into their establishment with such questions?

I totally agree with both of you. And the interesting part is the (black) security guards are doing all the harassing. Even though they are taking orders from their not-so-Kenyan-bosses, they take it a little too far. 1, why do they need 8 guards to contain 3 co-operative shoppers. Unless they knew they were so wrong in the first place and 2, since when did you need an I.D to shop at a supermarket? I think a new management should be in order and MOST of all the security guard sector should have a class to prevent this from happening again but living in Kenya all my life, even that wont help. Such is the Kenya we live in, man-handled by your own security guys.

I don't know what's more disgusting - your misplaced sense of importance and arrogance, or the way you were treated at art cafe - either way, I think you deserved it. Why don't you just stay in London and never come back, we don't need whiners like you in Nairobi, diasporan! That's my opinion.

Everyone is entitled to share on a platform such as this. Whether she lives in Kenya or not, the treatment should not matter. She is a human being just like you are who does not deserve to be treated in the manner that she was. If it was you, I'm sure you wouldn't have the same remark to make. To the writer and commenters, it is unfortunate that you received such treatment in a place that you shouldn't be harrassed. Business owners need to learn to treat people well and be courteous. The clothes I wear or the car I drive should not matter, I deserve to be treated with the utmost respect. Kataa hii!!

Mmmmmmmmmmhhh, I', mot surprised, I was there on Friday night with my friends. We were frozen at the door that its full and we couldn't go inside, as we were still exchanging words with the bouncers, 4 asians came and were ushered in, we protested and were told that the management reserves the right of admission. I was disgusted, I have to give the bouncer my piece of mind as I know him from Rafikiz where he previously worked as a bouncer. He was embarrassed and let us in............. I wouldn't bother going back there after being treated like that.

I can't believe this colonial behaviour still exists, and worst of all you'd think these new malls wouldn't behave as such. Most of their capital comes from the very kenyan citizens they are harassing, especially in those nakumatt supermarkets, thats why people bother to come!!..when people boycott lets see how well they will be doing in a few months!

Meh! First off you had to make 'distinction' that you are 'Diasporan'? Why the heck does that matter? It does not give you any special treatment over any other Kenyan so cut that 'Diaspora' crap. We are all Kenyans, under the same sun, breathing the same polluted air, stuck in the same traffic and being fucked by the same government...Be cool. Just don't go to Art Caffe then. Sell the London bags from your new Audi 4 somewhere else. Shiiiiiiiiiiii.. I can't figure out if this is about harassment of just another winter bunny with an inflated sense of coolness. I'll tell you what though....no one gives a hoot. You berra sell those handbags en masse cos fuel for 'your NEW AUDI 4' is gonna cost a pretty penny in this economy. You could get seriously sued for throwing around accusations about Art Caffe - real or perceived- like those without having verified the information e.g on whether just because a guard said so, the person you claim harassed you IS the owner. This is not a case of bad service, harassment or discrimination inside the premises....you need to be very careful. If you were harassed outside an establishment, you cannot drag the company into it. Your case rests is squarely on the individuals who perpetrated the act of breaking your handbag flogging swagga. You should be blaming individuals and/or 'THE JUNCTION' like your C200 friend has done. There is absolutely nothing wrong with guards exercising due diligence to ensure security and order in the mall- Same case goes for you Guest with the C200. Personally pretentious 'Diasporans' and drunk teenagers grate me to no end. The both of you could have chosen to air your grievances more effectively but obviously the models of your cars, that you know NGO owners who know affluent business men seems more important to you has watered down what might have been remotely considered a valid argument. This is what happens when security is privatized. Technically, it means that selling junk from your trunk is frowned upon. Take a chill pill honey. You are not alone...the hawkers in Nairobi are going through the same thing. They just can't seem to catch a break on where exactly to operate from.

That this is the 21st century and the fact there is a very black half kenyan man as the president of the most powerful country in the world and we still have idiots(foriegn) who practice this preferrential /discriminatory behaviour on the taxpayers of this country is just unbeleivable and laughable.The owners of this cafes and establishments, need to be made to undertand that this aparthied behaviour will not be tolerated anymore by we Kenyans.At times like these, i wish we had more Mugabes in Africa.Most of these people bribed their way into the country and set up businessess.They should not open a can of worms.If anything, we teach people how to treat us. A few lawsuits and very publicised consumer boycotts whould bring about the much desired attitude check on these "memsahibs" and "bwanas"

I beg to differ on the apartheid statement... Do your research on that, apartheid was caused by white people oppressing all other races mainly black people who were the lowest of the lowest, lower than even white owned dogs... In this case it is pretty much black on black. Secondly, we ourselves allow such things to happen, from the airport to the hotels, to wherever, our own people treat us like crap but white people are treated like gold. Let us first check ourselves before pointing fingers. The minute we start taking care of each other, that is when other people will start respecting us. Westgate has the same treatment by security guards and with the chief head being of foreign decent i.e. Israeli or Arab. You are treated like a thief and worse by your own fellow citizens who should know better but they've been brainwashed to worship foreigners especially whites. Really humiliating to go through this, you feel so powerless and enraged because this is your country! I boycott all the places I've had a nasty, racist and degrading experience.... Thanks to all for sharing, almost thought I was one of the few unlucky ones but by the look of things, the shameful treatments are rampant. Thanks Becky!

I have been to Art cafe countless times. Never been met by anything less than courteous and professional service. I have to say the story above, whether true or not, does not fit what I know of the Artcafe. please note I am not big on dressing sharp either nor do I look monied or urban. Actually am neither.

A similar incident happened to my wife at the Junction Mall earlier this year; the management [Knight Frank] does not care at all. They only seemed to cooperate when they realized I had covertly recorded the entire conversation with their unruly KK security; only then were they interested in "smoothing things out". Knight Frank promised to take action on the KK security culprits are are still there. I changed to Westgate, even if it is a bit off my route, I'd rather a place where I will be treated like with dignity than a second class citizen. ..Which country do "Diasporans" come from? I can't find it on my atlas or google

"...New Audi A4..." probably refers to a used 2001 accident repair moti from Singapore. Relax on the fake flossing, and btw like someone else has asked, who exactly are Diasporans? If I lived out of the country say for 10 yrs, but I'm back for good, do I count as a Diasporan? Or am I an ex-Diasporan at that point? Your business partner has a top NYSE company but you were nabbed peddling wares from the back of your "new" A4? Pole kwa the harassment, but what a pretentious hawker you are!

I think the complainant here clearly has an issue to contend with the management of junction,artcaffe and KK security.KK security don't have the right to unlawfully hold you without just cause and the mangement of both junction and artcaffe need to get the act right.I have been to artcaffe and never have had a bad experience and I don't think they get to see my audi A4 or my mercedes c200 nor do I think I'm dressed to whatever standards.the way the article mentions diasporan and the mention of whatever car you are driving is simply unneccesary and thinking on the level of your alleged captor,good service and treatment should come to all,whether your from kibera,korogosho or even west london.whether u drive a c200 or an A4, so does it mean if your were on foot you'd be happpy to be harrased,and then that punk who commented like he is the owner of artcaffe with threats, you idiot! Those threats could land you in jail whether you own or wash the toilets in artcaffe.the amount of complaints I've heard bout artcaffe seem a bit much and where it stinks,there must be shit.

First off what the diasporian needs to learn is that people pay rent to run businesses at these malls, you cant just drive your car to a mall and start running a business there maybe sell the car and pay rent for a store. Here we only have one side of the story, what if your friend by extension was actually a thief would you say that it was harassment, security have to counter check all things so as to be absolutely sure. This is like complaining about being searched when you enter the mall, since your from the 'diaspora' i guess you should not be searched. Think about the person who was robbed dont you think there is a duty to make that client happy by recovering the stolen goods? Dont think everything is about you, you should refrain from calling for boycotts just because your mutumba business was shut down in an upmarket area. For the guy who claims to be 21 I do not believe that this was the first time you were stopped meaning you have a baby face, so do not complain if you did not have an ID the place has rules and rules are there to be followed as you had been asked, if cops stopped u coz u look young and then you did not have your DL would that still be harassment? Bitching cant be a way of life, sometimes just swallow your pride i promise you its not fattening.

To the Diasporian. I am truly sorry for the way you were treated in your own country. No one should have to be treated like that whether they are local or foreigners. Please take it up with relevant people so that the issue can be sorted. To all those hating on the lady from London, don't hate appreciate. She is simply telling you that she is not a random person and does not look suspect. A word of advice to you all....sometimes all it takes is a conversation with the guard or whoever and all will be well. I think Kenyans are frustrated and always up for a fight.. Not always necessary...
