Warrant of Arrest Issued Against Moi's Son

Retired President Daniel Moi’s son Philip is being sought after a warrant for his arrest was issued by the court.

Court bailiffs were Wednesday looking for Philip to execute the warrant issued on Tuesday.

The deputy registrar in charge of the probate family division of the High Court on Tuesday directed bailiffs to arrest Philip for failing to obey a court order directing him to pay Sh60,000 as maintenance for his estranged wife and two children.

The court made the orders after lawyers acting for his wife, Ms Rosanna Pluda Moi, sought Philip’s arrest as he had failed to pay the money.

“You are hereby commanded to arrest the said Philip Kipchirchir Moi and bring him before this court with convenient speed,” reads the warrant signed by the deputy registrar.

Last week, the court refused to give audience to Philip unless he paid the money in six days.

On September 20, Philip had gone to court a day after Lady Justice Wanjiru Karanja directed that he be committed to civil jail for failing to obey a court order made on August 22 directing him to pay up.

But Justice Karanja refused to entertain his case and directed that he pay up as ordered.

On Wednesday, his lawyer, Mr Evans Ondieki showed the Nation a receipt for Sh60,000 made to Judy Thongori and Company advocates dated September 27.

Mr Ondieki said he had learnt of the warrant in the morning and he was making arrangements to file a case at the Court of Appeal challenging it.

The couple is embroiled in a divorce case filed by Ms Pluda Moi on December 24, 2008.

On May 24, 2010, Justice Roselyn Nambuye ordered that Philip pays Sh250,000 a month to Ms Pluda Moi when she had custody of the children and Sh150,000 when she was on her own.

Ms Pluda Moi says Philip has not paid and owes her Sh6.7 million.

In his application to have Justice Karanja’s order to commit him to 30 days’ civil imprisonment set aside, Philip says he is aggrieved because he was condemned without being heard.

“The decision to commit me to jail for 30 days was so drastic and did not take into account that I have been paying what I am able to raise in these economic difficulties,” Mr Philip Moi says.

The case will be heard Thursday morning.
