Former National Assembly Deputy Speaker Farah Maalim has filed petition seeking to have the re-election of National Assembly Leader of Majority Aden Duale as Garissa Town MP overturned.
Maalim wants the National Assembly Majority Leader’s win nullified on grounds that his election was flawed.
The former Lagdera Member of Parliament argue that Duale was not validly elected because the election of Garissa township constituency was marred with massive irregularities.
Maalim seeks to convince the court to order that the respondents in the case (IEBC and Duale) jointly and severally committed election irregularities.
Maalim wants the court to order Electoral Commission to avail all voting material including voter registers, counterfoils used in polling stations, electronic devices and equipment used during the polls in Garissa township constituency within 48 hours.
Further, Maalim alleges that Duale's supporters were allowed to vote more than one time and were not marked with indelible ink or keyed into kits as having voted.
He also claims that there were deliberate delays in areas perceived to be his strongholds on election day.
Duale garnered 22,587 votes to Maalim's 14,897 votes.
